California Family Code Section 2320 Residency Exception
California law normally requires at least six months of state residency and three months of county residency to file for divorce. Under Family Code section 2320, same-sex couples who married in California and whose current state of residence won’t dissolve their union may file in California without satisfying those standard requirements.
