Protecting your rights and role as a father

Fathers play a critical role in the lives of their children. It is clear that children benefit when they are able to maintain a strong relationship with both parents; yet, if you were unmarried at the time your child was born, it can be difficult to establish and enforce your parental rights.

If you are facing issues regarding your rights as a California father, you would be wise to take quick action to resolve these matters effectively and as quickly as possible. Your relationship and time with your child is on the line, but with help, you can fight to protect your role as an active, caring and present father.

What are your rights?

If you are the biological parent of a child, and there is no evidence to prove that it would be harmful to the child, you have the right to access and an active role in the life of your child. What that will look like specifically for you will depend on the details of your individual case. You also have the right to take whatever legal steps necessary to protect your parental rights.

How do I fight for my role as a parent?

If no marriage exists between you and the mother of your child at the time of the child's birth, you must legally establish paternity. The following can be helpful for you as you pursue this goal:

  • If the mother is willing, establishing paternity can be as easy as both parties completing some forms.
  • If there is a dispute regarding paternity, it will likely be necessary to have DNA testing done.
  • Once established, legal paternity will grant you the right and ability to have visitation and custody rights.
  • With established paternity, you will also have the financial responsibility of caring for your biological child.

You and the mother of your child can work together on a custody and visitation plan that works for you, or you may have to seek the assistance of the court as you pursue a beneficial plan.

The importance of a father figure

You know that you have an important place in the life of your child, yet you may need support and guidance in order to pursue a custody and parenting plan that acknowledges your role as the father.

Whether you need to establish paternity or simply want to know more about your parental rights, you may find it beneficial to reach out for help as soon as possible.
