The basics of a will

While thinking about what happens after death may not be pleasant, it is something that must be considered by everyone. Creating a will is a great way to ensure that any final wishes are carried out even after a person is gone. According to the American Association of Retired Persons, neglecting to create a will means that the deceased is labeled an “intestate” and all property transferred according to the specific laws of the state of California.

There are several things that a will can do. While it is only a part of the entire estate planning process, it is a necessary piece of information in order to stay in control of any property. The State Bar of California declares that a will covers three main aspects: who becomes guardian for any minor children, who receives assets and who manages all debts and assets. If desired, a trust can also be set up to house all assets for a time.

There are several things that a will does not cover. Items included in a living trust are distributed according to the current instructions. Properties that already have a named beneficiary, like retirement plans and life insurance policies, do not need to be mentioned since they are already spoken for.

Once a will has been created, it needs to be protected in a safe, fireproof box. While it is not necessary to divulge the contents to anyone, other people do need to know where to find the will so that the provisions of the document can be carried out.
