Court ruling results in unusual three parent custody agreement

One of the recurring themes that people hear throughout child custody cases in Oceanside is determining what is in the best interests of the children involved. While every state sets stipulations regarding custody matters, each also includes a child’s interests amongst the items considered when issuing a ruling. Some family courts may even go so far as to interview a child in chambers to try and determine what sort of arrangement he or she favors. That emphasis on representing a child’s best interests may even prompt custody decisions that many may consider to be odd.

Such a ruling was recently handed down in a custody case in New York. At the center of the dispute was a 10-year-old boy with one father and two mothers. His biological parents were not married but rather were neighbors, with the man being married to the woman recognized as the boy’s other mother. The three hand been involved in an intimate relationship for years, during which time the married couple agreed on the man fathering a child with the neighbor after the two of them had been unable to conceive. The two women eventually decided to leave the man and move in together, taking the boy to live with them.

In his ruling, the judge hearing the case made the decision to award joint custody to all three parents, stating that boy had developed loving relationships with each, and that it would be in his best interests for each party have equal time with him.

Parents who believe their children’s best interests aligns with their own may have to argue such a point in their custody proceedings. Mounting such an argument may be much easier if one has the assistance of an experienced attorney.
