Spousal Support and the "10 Year Rule"

Many people believe there is magic "10 Year Rule" related to spousal support and believe or have been lead to believe that just because you were married for 10 years or longer in the State of California, that either spouse is magically entitled to receive spousal support forever with no termination date. The reality is - there is no magical "10 Year Rule" that automatically grants one spouse or the other "lifetime support." However, California law provides that a marriage of "long duration" (10 years or longer) does allow the court to retain jurisdiction indefinitely over the issue of spousal support, unless the parties agree to a termination date or agree to waive spousal support all together.

The Court retaining jurisdiction does not automatically mean that spousal support will be awarded to one party forever.  It simply means that the Court will retain jurisdiction to continue to make orders regarding spousal support if either party petitions the Court for a modification.
